A man is suing the makers of Nexium and Nexium Acid Reflux Medicine, a heartburn medication used to treat heartburn and acid reflux.
A lawsuit claims the makers of the drug are trying to make the medication less effective, and that the drug is the cause of the condition.
The Nexium manufacturer and drug giant AstraZeneca has filed a lawsuit against GlaxoSmithKline (GSK) and its other major drug maker, which are in a legal battle to keep the drug from being made in the United States.
The case comes from a lawsuit filed by GSK’s patent-holder, GSK, against AstraZeneca. The company was sued over the patents it claims granted to AstraZeneca, which were expired in 2016.
GSK is now pursuing claims for claims that the drug was not effective in treating heartburn and acid reflux as a heartburn medicine.
GSK has said it has not taken action against AstraZeneca over the patents for the drug. The company is also seeking to recover damages for the company for failing to properly warn users that the drug may cause heartburn and acid reflux.
GSK’s lawsuit was filed in the United States District Court for the District of New Jersey.
The Nexium maker was sued by AstraZeneca in August 2013 over the patent claims it was granted to AstraZeneca for treating heartburn. AstraZeneca was the first manufacturer to file a suit against GSK.
The lawsuit also claimed that GSK and AstraZeneca did not properly warn consumers about the dangerous and potentially dangerous drug in their prescribing information.
GSK is seeking $2.6 million in punitive damages.
“The generic company failed to provide adequate warnings about the potential heartburn and acid reflux heartburn drug side effects. The drug was not effective, and the warning was not helpful,” GSK said in a statement.
GSK said in a statement it is seeking damages from AstraZeneca for the alleged failure to warn users.
“GSK’s actions, including failure to properly warn consumers and the use of the drug, are illegal in this country and we will seek to stop those claims,” it said.
